Rural Water Districts – Exclusive Territory



The League has filed two briefs with the Oklahoma Supreme Court this fall in support of the City of Guthrie’s lawsuit challenging the applicability of federal law’s monopoly service territory when a rural water district has obtained a federal loan.  Under Section 1926(b), federal law mandates that a loan receiptant has exclusive service territory to provide water – even if a customer or potential economic development prospect wants municipal water, sewer and fire suppression protection. The following brief was filed on September 21, 2009
