Court Cost Surcharge For Higher Fuel Cost?

OML is getting inquiries from city and town officials asking if it is legal in Oklahoma to add a charge to court costs to cover the ever increasing rise in fuel costs.  The idea is for municipalities to add a fuel surcharge via ordinance.  Several callers have mentioned that this is being done in other states.

Unfortunately, in Oklahoma municipalities may not add new costs, assessments or other charges to court-related fees.  These costs are governed by state law.  If a municipality needs to raise new revenue to cover fuel costs, it must do so in accordance with the statutes for raising taxes or it must look to other sources, such as raising utility rates.
